1. Acceptance of Terms
By accessing or using Fung Wan Online (the "Game"), operated by Yin & Yang ("we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not access or use the Game. These terms apply to all users, visitors, and others who access the Game.
2. Eligibility
You must be at least 13 years of age to register an account and use the Game. By registering, you confirm that you are 13 or older. If you are under 18, you confirm that you have obtained parental or guardian consent. Yin & Yang reserves the right to terminate accounts found to be in violation of age requirements.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. You are solely responsible for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorised use of your account.
4. Licence to Play
Yin & Yang grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Game for personal, non-commercial entertainment purposes. This licence does not include the right to collect or harvest any data, use automated bots or scripts, sell or transfer account access, or reverse-engineer any portion of the Game.
5. Virtual Items & Currency
All virtual items, currency, characters, and in-game content are owned by Yin & Yang and are licensed to you, not sold. Virtual items have no real-world monetary value and may not be exchanged for real money. Yin & Yang reserves the right to modify, remove, or reset virtual items at any time without compensation.
6. Prohibited Conduct
You agree not to: use cheats, exploits, or unauthorised third-party software; harass, abuse, or harm other players; impersonate Yin & Yang staff or other users; transmit spam, malware, or harmful code; attempt to gain unauthorised access to game servers; or engage in any conduct that disrupts the Game experience for others. Violations may result in permanent account termination.
7. Intellectual Property
All content within Fung Wan Online, including artwork, characters, lore, music, code, and branding, is the exclusive intellectual property of Yin & Yang. You may not reproduce, distribute, or create derivative works without express written permission. The name "Fung Wan Online", "風雲", and associated marks are trademarks of Yin & Yang.
8. Disclaimers & Limitation of Liability
The Game is provided "as is" without warranties of any kind. Yin & Yang shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Game. We do not guarantee uninterrupted or error-free access to the Game and reserve the right to suspend or terminate service at any time.
9. Termination
Yin & Yang reserves the right to suspend or permanently terminate your account at any time, with or without notice, for violation of these Terms or for any conduct deemed harmful to the community or the Game. Upon termination, your licence to use the Game immediately ceases.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable international law. Any disputes shall be resolved through binding arbitration. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
11. Changes to Terms
Yin & Yang reserves the right to modify these Terms at any time. Continued use of the Game following notification of changes constitutes acceptance of the revised Terms. We will endeavour to notify registered users of material changes via email or in-game notice.
